Civil Litigation

Civil Litigation has to do with any form of legal action which is non-criminal, usually when a party who has suffered an injury seeks damages or other redress from the person or entity which caused that damage.

Often this means taking on an insurance company but can also involve suing a private party, a business, the government or other organization. Usually a case is begun by making a demand for damages, after which the parties will assess their relative decision and determine if they can reach agreement as to whether someone deserves compensation and if so how much and in what form.

If the case cannot be settled then is goes to court in the form of a lawsuit, which is conducted according to the Massachusetts Rules of Civil Procedure, and can be a lengthy and complex process. Some cases are conducted on a “contingency” basis, meaning that although the client may be liable for expenses, there is no other legal fee due unless and until damages are awarded, in which case the lawyer will take a percentage of the damage amount as a fee.

If not a contingency case, legal fees can be significant, and it is necessary to constantly balance the desirability of going forward against the possibility of getting a return.
