Personal Injury

Personal Injury Law covers any wrong or damage done to your person, rights, or reputation. Personal injury law is often referred to as tort law. A suit seeking compensation for injury is considered Civil Litigation. A few examples include medical malpractice claims, car accident claims, slander or libel claims, premises liability, intentional and negligent failures to adhere to a duty of care owed to you or the public at large.

Generally, a plaintiff in a personal injury case must prove by a preponderance of the evidence that a legal duty existed, that legal duty was breached, and the breach of that duty was the proximate cause of harm. A plaintiff who is successful in making a personal injury claim is most likely entitled to damages but must prove the amount of damages they are seeking to compensate for their injuries.

In many cases no amount of money can fully compensate for the injuries incurred so we file suit and see just how much we can convince the defendant(s) and/or their insurers to pay prior to trial, but always with an eye to trial. If an offer to settle is not enough, as is too often the case, we go to trial.

Damages may include compensation for past and future medical costs, lost income, pain and suffering, emotional distress, and other factors. A majority of personal injury and property damage claims settle out of court with the aid of attorney negotiations and alternative dispute resolution such as mediation or conciliation.

However, if an out of court settlement does not occur, the case is ultimately tried in court where a judge or jury will decide who was at fault and, where a party is found liable, the amount of damages to which the injured party is entitled, which can include compensation for physical and emotional pain and suffering, physical injury, medical and related expenses, loss of earnings, loss of earning capacity and loss of consortium.
